Object
The present Conditions of Use (from now on the Conditions) have the aim of regulating the access, navigation and use of the web page (from now on the Portal, Web Site or Website) of Rforma through the address Rforma.com. The access, navigation and/or use of the Website, implies the acceptance of all the stipulations in these Conditions, as well as the Privacy or Data Protection Policy and the Cookie Policy.
There are, however, certain services and content accessible through the Web Portal, subject to specific conditions that may replace and/or complement these Conditions.
User Conditions
The User is understood to be the person who accesses, navigates and uses the Web Portal, the services and/or the contents hosted therein.
Browsing, access and use of the Web Portal does not require prior registration. However, there are certain services offered through the Web Portal, access to which will necessarily be conditioned by registration and acceptance of the particular conditions that will govern the service in question.
Access to the Web Portal by minors will be understood to be expressly authorised by their parents, guardians or legal representatives, who will be responsible for the acts that the minors carry out as Users of the Web in accordance with the applicable regulations.
Requirements for use
To access the Portal and the services offered, you will need a device that meets the requirements for hardware and software compatibility (which may vary over time) and Internet access. The User will be aware that these factors may influence the performance of the Web Portal and/or the possibility of accessing the services offered therein.
Rforma is not responsible for the impossibility of access or deficiencies in the functioning of the Web Portal and/or the services offered through it due to the use of inappropriate devices, or for interruptions in the Internet service due to saturation of the network or any other reason.
Rules of use
Use of the Service: the User undertakes in all cases to use the Portal and its services in a diligent, correct, lawful manner, in accordance with the law, the Legal Notice, these Conditions (and/or those applicable in each specific case), regulations for use and instructions brought to their attention, as well as with morality, generally accepted good customs and public order.
To this end, the user will abstain from carrying out any illegal, prohibited or harmful activity to the rights and interests of third parties, or which in any way may damage, render useless, overload, deteriorate or prevent the normal use of the services, the computer equipment or the documents, files and all kinds of content stored in any computer equipment of Rforma , of other users or of any user of the Internet (hardware and software).
Access Control:
the User will only be able to access those resources of the information system to which he is authorised.
Temporary Files:
the information stored in the Web Portal must be consulted about Rforma's systems without the latter being considered in any case responsible for the information that the User exports from these systems.
Conditions of use:
When the User is using the Web Portal, he/she will be responsible for guaranteeing that the information he/she handles cannot be seen by unauthorised persons.
The User expressly agrees not to store, use, transmit or disseminate:
Cracks, program serial numbers or any other content that infringes on the intellectual property rights of others.
Distribution of viruses through the Internet, worms, Trojans or any other destructive activity, such as saturation, mailbombing, etc. or denial of service attacks.
Activities that disrupt or interfere with the effective use of other people's network resources.
The collection and/or use of other users' personal data without their express consent or in contravention of data protection regulations.
Sharing the access codes provided (in the event that the user is registered as a user of a certain service that requires it) with another natural or legal person.
Destroy, alter, disable or in any other way damage the data, programs or electronic documents of Rforma or third parties.
To obstruct the access of other users by means of the massive and unjustified consumption of the computer resources through which Rforma provides any of its services, as well as to carry out actions that damage, interrupt or generate errors in these systems.
To use the system to try to access restricted areas of the server, without due authorization from Rforma.
Intellectual and industrial property
The design, images, labels, distinctive signs, commercial name, brands, logos, products and services, etc. contained in the Web are protected by the Industrial Property Law and are the property of Rforma, and it cannot be understood that the use of or access to the Web Portal and/or the services provided therein, attributes to the User any right over the aforementioned design, images, labels, distinctive signs, commercial name, brands, logos, products and services.
Likewise, the Web, its source code and the contents accessed through this site are the Intellectual Property of Rforma and/or third parties, and cannot be understood to have been transferred to the User in any way.
Rforma is the owner or licensee of all the rights over the content of the Web Portal and the services offered through it. The access to the Web or its services does not grant the Users any right or ownership of the intellectual or industrial property rights over the Contents that it contains. The User acknowledges and accepts that its use is strictly prohibited, as well as its reproduction, communication and/or distribution, modification, alteration or decompilation, whether for personal, private and non-profit making use or for commercial or profit-making purposes.
Rforma reserves the possibility of exercising the corresponding legal actions against those Users who violate or infringe the intellectual and industrial property rights.
Responsibility of the User
The User shall be responsible for:
Maintaining the confidentiality of the Keys provided, if any.
Providing correct information to Rforma, any error in the data provided will be its exclusive responsibility. In the same way, the User will be responsible for keeping all the information provided to Rforma up to date, so that it responds, at all times, to the real situation of the User.
The damages that may be caused to Rforma or to third parties due to the data provided, as a consequence of the use of data that is not updated, false or does not correspond to reality, and due to the use by third parties of the User's personal passwords.
In the event that the User obtains a copy of his/her clinical data, he/she will be solely and exclusively responsible for the use and custody of said information.
Availability of the Services
The information, contents or services offered through the Web are those that Rforma decides at each moment and can vary throughout time. Therefore, there is no obligation on the part of Rforma to keep the services available. However, Users will be informed when they decide to cancel the continuity of a certain service and the conditions of its cessation.
Likewise, Rforma will be able to cancel the access to the services, totally or partially, to those Users who do not comply with these Conditions.
Rforma's Guarantee and Responsibility
Although Rforma uses systems that are compatible with most of the technologies on the market, it cannot guarantee the compatibility of the devices used by the User.
Rforma does not guarantee the availability and continuity of the functioning of the Portal or the Services offered. Therefore, it will be exempt from any responsibility derived from the access and use of the Web or the services offered through it (failures in the performance, interruptions or delays in the operation of the Services, failure of the system or the line, etc.), even if some failure or malfunctioning occurs that causes damage to computer tools of third parties. In this sense, the User accesses the Web and the services under his own responsibility.
The services offered through the Web Page comply with the provisions of the Spanish legal system.
Rforma is released from any responsibility in the event of improper use of the Website and/or the services by the User.
Rforma will not be responsible in the case of unavailability of the services due to force majeure or temporary suspension of the same for technical reasons. Therefore, Rforma will not assume any responsibility for damages, losses that may be suffered as a consequence of events that could not have been foreseen, or that were inevitable, either due to a fortuitous case or force majeure.
Rforma does not accept responsibility for any fault, technical error, accident, breakdown, manipulation, interruption in the services or any other incident that may arise in products, equipment or technical services that are not the responsibility of Rforma and whose use is necessary for access to the services.
Although Rforma has acted diligently and has adopted the necessary measures, in accordance with the state of technology, to avoid possible breaches in the security of the Portal, the absolute impossibility of vulnerability of the security measures adopted cannot be guaranteed.
Rforma is not responsible for the legality of other third party web sites from which the Portal can be accessed. Nor does Rforma respond for the legality of other third party web sites that may be linked to or from this Portal.
Modification of the Content and Conditions
Rforma may add new functionalities to the Web and/or modify the current Conditions. In this case, the update will be published on the Portal so that the User is aware of any changes. If the User does not agree with the new conditions, he/she will have a period of fifteen calendar days from the communication to resolve the contract by means of reliable communication to Rforma . The passing of this period without the User having stated anything to the contrary, will imply the full acceptance of the new conditions.
